UTLA v. LAUSD Perb Decision

Public Employment Relations Board affirmed the decision by LAUSD not to select 11 teachers at Crenshaw Magnet in 2013.  In its 82-page decision, PERB determined that UTLA failed to establish that the District released those teachers for the discriminatory reasons as set forth in the complaint. 

In particular, PERB concluded: "[W]e agree with the ALJ that [the Principal] credibly and persuasively testified regarding his reasons for not selecting most of the displaced teachers."  PERB concluded that "there was simply insufficient evidence to prove that the District would have selected the[se] displaced teachers for new positions absent the protected activities alleged in the complaint."  Hence, those allegations were dismissed.
